Another case of First Amendment violation has been stymied by the AFA Center for Law & Policy (CLP).

Students in the LeMars (Iowa) Community School District had been told they would not be allowed to have a moment of silence at their graduation ceremony. The CLP, in conjunction with local counsel Daniel D. Dykstra, filed a federal lawsuit against the ban. The school district agreed to a settlement that allowed the graduating class to have its moment of silence.

“This is a major victory for students at LeMars Community, and most importantly, the First Amendment,” CLP staff attorney Joseph R. Murray said.

In response to the LeMars ban, the CLP filed suit in Federal District Court in Sioux City seeking a temporary restraining order preventing the school from excluding the moment of silence.

“LeMars Community should be commended for the decision to reinstate the moment of silence,” said CLP Senior Litigation Attorney Michael J. DePrimo. “While the school was operating under a good faith belief that the moment of silence may violate the Establishment Clause, the facts of this case failed to justify such a conclusion.”
